Marchex Hit with a UDRP on The Domain eBottle.com By Owner of eBottles.com

Marchex has been hit with a UDRP on the domain name eBottle.com

The Complaint was filed by Lerman Container Corporation.

Marchex has owned the domain name since at least 2009.

The Complainant Lerman Container Corporation, has a federally registered trademark on the term eBottles.com which is applied for on May 21, 2013, which was Published for Opposition on October 28, 2014 and was finally granted 3 weeks ago on January 13, 2015.

The domain name eBottles.com is registered to a Josh Erlanger, not to the Corporation that applied for the trademark nor is the Complainant in this case.

It appears Mr. Erlanger acquired the domain name in 2003 from its form owner DomainCollection.com although at that time the name of his corporation was “Custom Bottle”

We will keep you up to date on this case.

    At first, I thought ebottles / mjbottles was a large company. But, I guess not.
    Marchex has deeper pockets so they should be able to easily fight this.

      Anyone else realize the imitation of the blue-green star between the ‘e’ and ‘bottle’ that the company *borrowed* from eTrade.com?

    Looks like the case has been settled as the UDRP has been withdrawn

    I wrote to Marchex’s Counsel who had no additional information he could share
