According to a story in Xbiz.com, Hustler has come out swinging against. XXX and anyone who plans to registering or obtaining a .XXX domain name containing one of there trademarks.

In a statement sent to Xbiz.com and AVN.com, Hustler President Michael Klein said:

The ICM registry is “prohibited from registering or selling to a third party any .XXX domain names that contain the famous Hustler trademark or other Hustler-related trademarks.”

“It appears that the .XXX TLD will do nothing but drive up costs to the adult community and will force us to fight infringement on yet another front.”

“Like many other companies in the adult industry, Hustler will not allow its trademarks to be bought, sold or used by any other entity nor will be we be shaken down by ICM,”

“We are prepared to take whatever legal action may be necessary.”

“We are constantly policing the registration and use of domain names that attempt to capitalize on Hustler’s trademarks,” said Jonathan Brown, attorney for Hustler. “ICM’s silence is particularly disconcerting, especially in light of ICM’s supposed aim of ‘working proactively to balance the rights of … existing domain name holders, and other trademark and intellectual property holders.’”

.XXX is set to go live in the fall of this year.

Trademark holder will have a right to get their domains in the Sunrise period prior to other applicants for a higher price as well as have the right to block the .XXX domain containing their trademark for a ten year period for a one time payment of several hundreds dollars.

not a single adult industry company has come out in support of .xxx .
DotXXX has NO support in the adult industry whatsoever.

.XXX is a scam. A business model based off trademark registrations is very crappy. They should lobby the XXX community and try to get some real usage like the .CO guys have done so far.

Strange that .XXX has little support from the adult industry but with 900,000 applications I guess ICM is good to go..can Hustler(Trademark ‘owner’) sue a registry for a choice made by a registrant? Not really, I think UDRP will take care of that.
