The Domain PurpleHeart.com Is Lost In A UDRP

A three member UDRP panel,  has awarded the domain name PurpleHeart.com to the complainant the “Military Order of the Purple Heart  Service Foundation, Inc.”

The organization has 4 trademarks on the term in the US, and the oldest one is dated 1998.

The organization also has 8 trademarks in the US for the term “Military Order of the Purple Heart” or variations thereof.

The domain holder is listed as , WhoIs Privacy Services Pty Ltd / Robert Capps

A Purple Heart is a military honor, awarded in the name of the President to those who have been wounded or killed while serving on or after April 5, 1917 with the U.S. military and this looks to be a good decision.

    Have to agree here and Mike as a step father to kids at war, you should too. Squatters should never fuck with our national blood and treasure. Plenty of other domains to pick on.

    Before you cheer too loudly for this decision, you should consider that the next decision might take away something like WhiteHouse.com.

    After all, isn’t the White House a sacrosanct symbol of democracy?

    I’m not saying that the complainant isn’t worthy of the domain–they probably are. Just that we should be careful before jumping on the happy bandwagon for a decision that could come back and bite some of those big boy domain owners (of dubious domains) in the posterior.

    To be quite a challenge . Wonder did the use of Funds as specified in section 501.3c is that what paid these
    Legal fees?

    Amazing never says anything as what is endured upon some of our returns??
    I hope to get this overturned but we shall see.
