UDRP Winners: The Kentucky Derby, Red Bull, Jay-Z, Apple, Google, McDonald’s, Holiday Inn & Gucci

In a bunch of UDRP cases either decided, withdrawn or terminated in the past few days, The Kentucky Derby, Red Bull, Jay-Z, Apple, Google, McDonald’s, Swarovski, Dolce & Gabbana, TD Bank, Holiday Inn, Betsey Johnson, DrMarten, Fandango & Gucci all got domain names awarded to them.

KentuckyDerby.info was awarded to Churchill Downs Incorporated (case # D2012-0769)

BetseyJohnson-outlet.com was awarded to the clothing designer’s company. (case # D2012-0755)

RedBullFacts.com was awarded to Red Bull. (case # D2012-0722)

Shawn Carter a/k/a Jay-Z got the domain name Jayzgroup.com (case # D2012-0976)

Apple got the typo domain name Aplestore.com  (case # D2012-0880)

Swarovski got the domain name Swarovski-bijoux.com  (case # D2012-0629) and swarovskicrystalmall.com (case #D2012-0523)

DrMarten got the domain name drmartensale.com (case #D2012-0631)

Holiday Inn got the domain names HolidayInnfranchise.com and HolidayInnkandooma.net (case #’s D2012-0756 & D2012-0757)

McDonald’s got the typo domain Mcdcnalds.com  (case # D2012-0624)

The Toronto-Dominion Bank a/k/a TD Bank got the domain name (TDcanadatrust.xxx)  (case #1442973)

Fandango got Fangango.com, Fandingo.com, Fandadgo.com and Fanadango.com all in one case (case # 1439412)

Google got the typo domain Gmai.com (case # 1435467)

Dolce & Gabbana got the domain name dolcegabbanastores.com (case # D2012-0699)
Gucci got the domains groupgucci.com,  guccichildren.com, gucci-parfum.com, gucci-parfums.com and guccisports.com all in one case (case #D2012-0357)
While we point out cases where the panel’s came to the wrong decision and more importantly, cases in which a UDRP panel have no business hearing, these are exactly the type of cases the UDRP was set up for.

    Gmai.com awarded to google is a very interesting case (in Spanish language though). 3-members panel made it clear that displaying scummy surveys like of known “rewards channel center”, where a free ipad is offered in exchange to personal information [and, in fact, they’d charge customers so it is not free’] IS bad faith. It is a big red flag for all domainers parking domains through major parking providers. Last time I checked, this so-called survery was one of the main zero-click configuration destinations offered by domainsponsor for all domains [random %%% of traffic if no opt-out received], bodis (for domains blocked by google), and, if I am not mistaken, sedo (not sure).
