iMEGA Files Another Motion With Appeals Court in Kentucky Domain Seizure Case

The Interactive Media Entertainment and Gaming Association (iMEGA) filed another motion with the Court of Appeals in Kentucky today, this time asking the court to stay the 2 orders entered by Judge Wingate and suspend the forfeiture hearing presently scheduled for for December 3, 2008.

In the 6 page motion, (153 pages with all exhibits) iMEGA states that the orders of Judge Wingate have caused and will continue to cause immediate and irreparable harm.

Last week on October 22, 2008, iMEGA filed a petition with the Kentucky Court of appeals seeking dismissal of the original action on the basis that the trial court was proceeding without jurisdiction and in violation of: the right of free speech granted by the First Amendment to the Constitution, the Fifth Amendment for failing to give due process to the domain owners,  and the Fourteen Amendment for impeding interstate commerce.

PokerNewsDaily.com is reporting that a 3 judge Court of Appeals panel will meet on November 18th to consider the two petitions filed by iMEGA.

Once again we applaud iMEGA for taking the lead in fighting for the rights of its members and thereby all domain owners.
