Marchex Gets Hit With UDRP on WebAnywhere.com

A UDRP has just been filed against Marchex Sales, LLC  on the domain name WebAnywhere.com

The domain name has been owned by Marchex since at least 2008.

There is a trademark filed with the USPTO in February 2010 for the term Webanywhere by a Delaware company by the name of WebAnywhere, Inc. which was granted in Feburary 2011 for “website design for others, namely, educational institutions and business entities; providing computer programming services for others, namely, educational institutions and business entities that enables the educational institutions and business entities to maintain, repair and update their own websites; consulting services in the field of designing websites that track and report online performance of the website.”

According to the registration the term was first used in 2007 but first used in commerce in 2010

“FIRST USE: 20070828. FIRST USE IN COMMERCE: 20100502”

The domain goes to a very generic parked page.

Sounds like another RDNH case for Mr. Berryhill.

    Some SCHMUCK company and their SCHMUCK Attorney need to KNOW that I will plaster their names EVERYWHERE I can and will OWN their reputations or what is left of it and when they BEG me to REMOVE them from RICKSBLOG.com the answer will always be NO!

    They have their chance NOW not after!!

    I think it is time to be PROACTIVE because we know what Reverse Domain Hijackijng looks like now and we can be pre-emptive. Would-be Thieves need to be exposed as they go thru the process.

    Makes this domain and other generic / common use stuff that can’t be usurped worth that much more in the end.

    So, what is the estimated total cost to defend against a UDRP, with a 3-member panel, assuming the domain holder is able to utilize the legal expertise of Mr. Berryhill (or Mr. Neu)?

    Just looking for an estimate for those of us who have a few good domains and want to know what our estimated out-of-pocket costs will be to defend.

    Looks like these fine folks reserved WebAnywhere.us on Aug 28, 2007 – surely had they done their proper due diligence they would have seen that WebAnywhere.com had a create date of April 7, 2002 – meaning the generic domain was already in use – its use irrelevant 🙂

    My god, you can’t get much more generic than the term “web anywhere”!

    I will enjoy seeing this company ridiculed after they fail in their domain theft attempt.
