12 Year After Losing UDRP, College Sues Graduate For $100K Over Same Domain

April 1, 2013 by Michael Berkens

In a story that appeared in ChristianPost.com, Pensacola Christian College in Pensacola, Fla. has filed a suit against a former graduate  Peter Gage over the domain name PensacolaChristianCollege.com (PCC) seeking statutory damages of $100,000 under the Anticybersquatting Consumer Protection Act (ACPA)

It looks like Mr. Gage and the school have been battling it out over this domain since 2001.

Peter Gage graduated in 1996.

In 2001, PCC filed and lost a UDRP against Gage with the panel finding the the pay per click ads on the site were incidental to the the purpose of the site, “which was to express and allow others to express opinions and criticism of Complainant’s activities, policies and rules…this constitutes a legitimate right and interest in respect of the domain name and constitutes fair use.”

“Since 2001, the college has twice asked to “purchase the domain name, but Gage asked for a payment of $75,000 to either himself or a charity”

The case is Pensacola Christian College Inc. v. Peter Gage, and was filed on March 25 in the Florida Northern District Court
