Update On Manwin Vs ICM on .XXX: Motions To Dismiss Off The Calendar: Settlement Talks Underway?

In the ongoing lawsuit that Manwin filed against ICM Registry and ICANN over the .XXX TLD,  the parties today entered into a joint stipulation that allows Manwin to file an amended complaint by January 17th and gives ICM 60 days to file a response to the complaint.

You may remember that ICM filed motions to dismiss the case filed by Manwin, the  operator of adult sites such as YouPorn.com in January and the Court scheduled a hearing on the motions for April 2, 2012.

Included in the documents filed in the court today is a stipulation that the hearing will be taken off the court’s calendar for now.

Moreover the stipulation indicates that the parties are in settlement talks which could end the matter,  or some of the issues in the case:

“”In addition, in recent days, Plaintiffs and ICM have engaged in discussions aimed at resolving the disputes that are the subject of this litigation.”"

“The parties believe that additional time would potentially allow the parties to resolve all or some portion of their dispute”

“”The Parties hereby stipulate that Defendants shall have 60 days from the filing of the amended Complaint to file an answer, motion or other response thereto.”

“By continuing the response date for the amended Complaint for 60 days, the parties will be able to focus their energies on these efforts, and avoid unnecessarily expending the parties’ and the Court’s resources.”

    Yes, thats what I was looking for.

    IMO, the results must have been poor if they don’t want to publish.

    Well that is a reasonable conclusion that one could draw

    The official word I got was that it was a matter of privacy for the buyers and being an adult extension they didn’t want to publicly out the buyers.

    MHB is correct in that as a “adult” extension many buyers dont want the names they bought and there identities made public.

    The auctions went just fine.

    the top priced name which was eight characters went for $121,000 and another 15 character domain went for $44,000.

    we had many four and five figure bids and across the whole spectrum, when all said and done the average price was just under $1,000, which from what i can see seems too be about the norm for these type of auctions.

    Total names under management is now 209,219 as of midnight UTC yesterday.

    We will be releasing a list of some premium generic names that are available soon and we continue to enter in contracts on almost a daily basis for five figure domains.

    Thank you Stuart. In total, I purchased 10 .XXX generic brands.

    Through the .XXX Land Rush/Sunrise auction, I bought SanDiego.XXX and SanFranciscio.XXX.

    I am very pleased.
