I found one trademark in the US trademark database for the term LSDA and it goes to a locksmith company.

The trademark is was granted in 2010.

The domain name original date of registration was 2001.  According to Frank’s company has owned the domain name since at least 2006 (the oldest record).

Its an important case since Frank has also applied for 54 new gTLD’s applications under and the new gTLD Guidebook, provides that an applicant is disqualified if they have 3 or more  UDRP loses with 1 coming in the last 4 years.

However based on the registered Trademark, look for another slam dunk win by Mr. John Berryhill when this case goes before a three member panel with hopefully a finding of RDNH.

    Just because it is offered for sale on his platform – does not mean the complainant is the only buyer – or has rights to be the only buyer – a quick glance shows many’s mutually exclusive to both parties – and with production sites.
    So the fact that their might be only one us registered TM for some kind of lock company or association – cannot carry too much weight – yes?

    That said – it is just a complainant with quick drying cement in between their ears playing the lottery.

    I would think that when a trademark registration comes *after* the registration of a domain, especially after as many years as it appears here, it should be a no-brainer that the complainant should lose.

    Otherwise, anyone could look up a domain name they’d like to own, and in the likely case that there isn’t a trademark for it already, register the trademark, then wait a year or two and file a UDRP.
