looks like you are right... I just went by the TM's that they directly referred to:
"EZPAWN® and EZMONEY® are federally registered trademarks of EZCORP, Inc"

interesting that they intentionally left out the space...

Whatever. My point still is that it isn't NameJet's job to police every single name that may have a TM on it, especially since just about every common word has at least one TM tied to it..

Names like ToyotaParts.com, ChanelPerfume.com, NikonLens.com, AdidasSneaks.com... I can see putting a stop on those... maybe...

but here is the problem... Where IS the line? Where does it stop? Even if there was a filter and NameJet said "no, we won't auction this".. what happens? If Netsol keeps it and monetizes it themselves - that certainly isn't ok. If Netsol does what it is supposed to do, delete the name, what happens? Any one of the other drop services will grab it on the drop and it WILL go to auction somewhere. It won't go unregistered.

Before you cry for some mechanism to "fix" this, be very careful what you wish for. Somewhere, someplace, somehow.... there will always end up being a "TM" from "somewhere" on every name that will make the filter so tight that even "money.com" would not get through.

I hate that there is so much real TM infringement in our profession, I really do. The people that purposely exploit that to make a buck give us all the lovely "cybersquatter" moniker in the eyes of the world - and that pisses me off.

But the fact is that there is already laws and mechanisms in place to protect TM holder's interests. If there is a valid claim, the TM holder will prevail. (and sometimes with ridiculously weak claims as well, but that is for another time). The UDRP and the court system works.

If you think things are tough under the current system... just wait until you get your with for registrars/drop services/whathaveyou to play BigBrother for you... you won't like that one bit.

Each of us does, in fact, have the most powerful weapon of all to use against this this though.
Common Sense, Responsibility, Respect, and Restraint.
Don't Bid On It! Don't Register It.
NikkeAers.net? "Just Don't Do It"

Don't cry for someone else to do it for us. We need to do it for ourselves.
'Cause if we don't... someone else will.
And THAT is they day we all get jacked.
And that is the point.

after a little research, that statement on the website ezmoneypaydayloans is a load of bull...
Yes, there is one TM for EZMONEY... owned by an outfit in Las Vegas, not Texas... and it is for Gambling, not loans!

No registered TM exists at all for EZPAWN

peole seem to be ignoring the fact that there was never a challenge for the domain by the supposed TM holder in over 10 yrs...

I don't see NameJet getting away with auctioning off something like Pepsi.com but this one hardly warrants all the fuss, IMO.

And all the comments on "when this gets taken away... Namejet is going to say... etc" is argument by assertion, speculation...

Namejet is a scumbag operation. PERIOD
There are EASY trademark issues that should never be sold and they know it. They are liars and have ZERO customer service.

Oh and let the buyer beware is crap!

YOU SHOULD NOT BE ALLOWED TO SELL TRADEMARK DOMAINS IN ANY CASE, THERE ARE ZERO EXCUSES AND BUYERS SHOULD KNOW BETTER ALSO, BUT THE TEMPTATION WOULD NOT BE THERE IF THESE SO CALLED LEGITIMATE PEOPLE WERE NOT SELLING THEM

And that doesnt even count the shill bidding going on at Namejet, good luck to anyone that buys there

IMO Namejet shouldn't have allowed this domain to be sold. But guess what if/when the "winner" loses the domain, Namejet will say, "you should have looked for trademark issues before you bid." Too bad. We look forward to doing business with you again in the future...

Now they may argue, "How can we possibly check for trademark issues on all the expiring names which run through our marketplace?" Good point - just worry about the ones people bid on. And why can't you issue a refund? Afternic does trademark reviews on domains which are merely listed. Why can't Namejet do reviews on names they sell and make money off of? What ever happened to customer service?
