POOL.com Top Drop List Is Full Of Trademark Infringing Domains

2009 January 11
by Michael H. Berkens

Everyday pool.com sends out a list for the Top Deleting Domains for the next day.

If you check out Pool.com “Top Deleting Domains” list for tomorrow, I think you will see a common theme, trademark infringing domains.

Actually out of the 30 domains listed, over half, 18 by my count, are bang on trademark infringing domains.

I understand that if a domain is scheduled to drop, it’s going to drop, but why advertise them and send out a newsletter highlighting such crap?

I agree Wanna Develp……..Pool.com is full of trash, SnapNames.com is not much better.

It makes me almost sick to see Pool.com selling these trademark domains in this era……it just makes us all look like shysters.

They are also keeping the UDRP process chock full of squatters which starts to give the panelists the impression that all of us are TM registrants or TM typo registrats…….. and that is becoming a big challenge for us legitimate guys and gals.

    Johnny, they sell the leftovers…

SN and NJ clean house…. Pool is left with the crap.

    Been like forever now.

    Best,
    Mike

I can’t imagine someone hasn’t notified Amazon at this point. I’m assuming Pool.com must have no legal staff. Or they’re really desparate for sales, considering NJ and SN offer higher quality expired names.

Don’t kid yourselves. While I agree that Pool should certainly have better filters on their daily list, we have to remember that that list is a direct representation of just how many people already have placed orders for those particular names, making them the “Top Domains”

So, yeah, it may be stunningly retarded for Pool to send such a list out unchecked by a sensible filter system, but it is (us?) the clientele that are making those names hot commodities.

Also remember that both SnapNames and NameJet will be chasing those same names for those same clients at the same time – these are drops.

That said, very lame to send out bulletins announcing such egregiously offending TM names…

    Bad form, Pool. Very bad.

I once challenged Pool about this on a forum and was told that their list is based on customer backorders – the domains with the most backorders are what appear on the list.

This may or may not absolve Pool of the issue, but in that light shows an even more depressing look at what this industry still is.

The list is based on the number of back orders, but it would only take 2 minutes a day for someone to eyeball the list before allowing it to be sent to scrub all the crap out.

Having said that, it is a sad situation that such domains get any back orders, much less the most.

If this is what people are wanting to backorder – The our industry is in serious trouble.

Yes we all know that having TM names are wrong and most of us have at some stage owned a domain and deleted it as we realised it was wrong but the issue I see here is that many many domainers are still backordering these domains even though they know that WIPO list are growing – Time are hard everywhere so big organisations arent going to let these TM infringements carry on they are going to crack down hard on these people and this shall bring more bad light to our industry.

Pool.com should stop allowing this – Yes they need to make money but cmon do it discrete if you are going to be a part of this problem!

I hope they get a warning letter over this from Amazons lawyers.

    Regards,

    Robbie

The list is not one I would want to associate my company with. Pool are hurting themselves if they fail to take proper action on the issue. Willingness to auction off such clearly infringing names tarnishes reputation and credibility.

I agree, listing obvious TM infringement domains is non-productive for the general domainer.

I can’t imagine them going for much on the auction page.

I think I will back order them and see what they go for.

  13. 2009 January 12

I agree that this is a pretty shameful list, but I am pretty sure it is an automatically produced list. Pool are not suggesting these names be backordered, so much as saying these are the most backordered names from their site. Considering the calibre of name at pool has regressed to the worst of the worst, with all the best going to nj and snap, it isn’t that surprising that this is what their customer’s are chasing…

    Accurate

The automated argument only goes so far.

What if havesexwithsmallchildren.com was the biggest back order domain for the day, they would actually put that on a list and send it out to thousands of people, really?

Especially when it would literally take 2 minutes a day to manually check the list before it went out and scrub it.
